Sparkforge updated its Terms of Service and Privacy Policy to clarify how the platform works and how data is handled. The changes take effect September 22, 2025.

Terms of Service updates

Your responsibility for data privacy compliance

When you use Sparkforge to collect and manage your clients' data, you are responsible for following applicable privacy laws including GDPR and CCPA. You must obtain proper consent from clients before collecting their information through the platform.

AI features guidelines

A new AI Policy explains how Sparkforge AI tools work and sets guidelines for responsible use. Review AI output before using it with clients. AI is powerful but imperfect, so human oversight matters.

Domain name management

Sparkforge can now manage domain names purchased through the platform, including resolving disputes such as trademark complaints. If a complaint is filed, Sparkforge can handle the legal process and resolve the issue.

HIPAA add-on requirements

For HIPAA-enabled accounts, your Business Associate Agreement (BAA) is now tied to an active paid subscription to the HIPAA package. If the subscription lapses, the BAA may automatically expire.

Tax calculation terms

New terms cover tax calculation features. Sparkforge connects you to tax calculation services; you remain responsible for tax compliance for your business and clients.

Privacy Policy updates

Sparkforge's role

The policy clarifies when Sparkforge acts as a data processor (handling data on your behalf) versus a data controller (responsible for its own data collection).

California privacy law

Under California law, some standard practices like affiliate marketing and advertising pixels may be considered "sharing" or "selling" data. This does not change how data is handled; California defines selling broadly to include common marketing activities, even when no money changes hands.

Affiliate program

When you sign up through an affiliate link, Sparkforge shares basic information with that affiliate. This is standard practice for affiliate programs.

Subprocessor updates

Three new AI service providers were added as subprocessors: Retell AI, Synthflow, and Botpress. They power specific AI features including voice AI, conversational flows, and chatbots. Their role is limited to the AI features you choose to use.
